Incident May Have Involved Teen With Mental Capacity Of 10-Year-Old
OCALA, Fla. -- For the second time this year, students at a Marion County high school are under investigation for having sex in a classroom.
Investigators say the incident took place in a classroom at West Port High and that at least one person witnessed the act, WESH NewsChannel 2 reported.
It involved a 15-year-old girl and a 17-year-old boy, but sources told NewsChannel 2's Stephen Stock that the 17-year-old tests mentally at around age 10. Prosecutors said they may consider the boy a victim.
Ocala Police detectives and state prosecutors are still investigating exactly what happened in the West Port classroom. Investigators believe other students and a full-time teacher were also in the classroom when the oral sex act took place.
"These kids, these two kids in particular, were careful about what they did. They took action to conceal what was going on," said Kevin Christian, a spokesman for Marion County schools.
A source within the state attorney's office said the boy involved may have the mental judgment of a 10-year-old. Because of that, this source says psychological tests will have to be run. It could be weeks before prosecutors make a decision on whether to file charges.
Even so, that same source questioned how this could happen again, with a teacher present.
"It's really too early to tell whether the teacher acted appropriately or didn't act appropriately. But regardless, once we have the results of that investigation, we'll act appropriately," Christian said.
In February, a similar sexual tryst occurred in a darkened classroom where students were watching a movie. A substitute teacher was present but did not witness that incident either. She was later fired. Both students in that incident were expelled and were later convicted on criminal charges.
"We live in a different age now, and kids are very open with their sexuality and they are not afraid to show it," Christian said.
A prominent school psychologist said that has profound effects on both teachers and other students.
"The question is what are the most appropriate ways to deal with it, to try and prevent it and still educate students," said Matthew Lane, the psychology director for the county's schools.
School officials are also looking into discipline for the students involved. They want to send a message that changing times or not, this will not be tolerated on any campus in Marion County
